Contractor Terms of Website Use
Please read these terms carefully before using this site.
These terms tell you the rules for using our website watertrust.co.uk (our site) as a contractor — whether as a guest, an applicant, or a registered account holder. By using our site you confirm that you accept these terms and agree to comply with them. If you do not agree, you must not use our site.
These terms are for contractors who apply to, are vetted by, or buy leads through WaterTrust. Separate terms apply to customers who submit jobs.
About us
watertrust.co.uk is a site operated by WaterTrust ("we", "us", "our"). To contact us, email support@watertrust.co.uk.
Other terms that apply
Our Contractor Privacy Policy sets out how we handle your personal information. You can read it at our Contractor Privacy Policy. You confirm that the information you give us is accurate.
When you buy a lead, the purchase is also governed by our Terms and Conditions of Supply, which set out the terms of the sale itself (including pricing, purchase limits and refunds).
Note for WaterTrust: a separate "Terms and Conditions of Supply" document should be produced to sit alongside these website-use terms — it governs the actual sale of a lead, as distinct from use of the website.
Applying and being approved
Access to leads is limited to contractors we have approved. We may approve contractors by invitation or by application, and we decide in our discretion whether to approve, decline, suspend or remove any contractor. As part of vetting we may review publicly available information about your business, including your public reviews and your insurance and accreditation status.
Opening an account and buying leads
To open an account and buy leads you must provide:
- your debit or credit card details, to fund your account
- your full contact details, including a telephone number
- details of your public liability insurance
- proof of any relevant qualifications, memberships or accreditations for the services you provide (for example WIAPS or WaterSafe)
Leads are bought from a prepaid balance on your account. Each lead may be sold to a limited number of contractors, after which it closes. Full details of pricing, purchase limits and refunds are set out in our Terms and Conditions of Supply. Refunds, where due, are made as account credit rather than cash.
You are responsible for checking the information shown about a lead before you buy it. Once you have bought a lead, the customer's contact details are released to you so you can contact them about their job.
Your account and password
If you are given or choose a username, password or other security information, you must keep it confidential and not disclose it to anyone. We may disable any account or credential at any time if, in our reasonable opinion, you have failed to comply with these terms. If you suspect anyone else knows your password, tell us promptly at support@watertrust.co.uk.
You can close your account at any time. Please note that once your account is closed you may not be able to register a further account with us.
Our relationship with you and with customers
WaterTrust is an introduction service. We are not a party to any contract between you and a customer. Any contract for services is made directly between you and the customer, and we accept no liability for any death, injury, loss or damage caused to you, your employees or your sub-contractors while working at a customer's property. By accepting these terms you confirm that you hold appropriate insurance in place for the work you carry out.
Nothing in these terms creates any partnership, agency or other business relationship between you and us. You must not represent yourself as being connected to, or acting on behalf of, WaterTrust.
Changes
We may change these terms at any time by amending this page, so please check it from time to time. We may also update or change the content of our site at any time, and we are under no obligation to keep it up to date.
Accessing our site
We do not guarantee that the site, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or change all or any part of the site without notice, and we will not be liable if it is unavailable at any time. You are responsible for the arrangements needed to access the site, and for ensuring anyone who accesses it through your connection is aware of and complies with these terms.
No reliance on information
The content on our site is provided for general information only and is not advice you should rely on. While we make reasonable efforts to keep it accurate, we make no guarantee that it is accurate, complete or up to date. This includes the information shown about any lead, which is provided by the customer.
Our liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under English law.
To the extent permitted by law, we exclude all implied conditions, warranties and other terms, and we will not be liable to you for any loss or damage — whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable — arising from:
- your use of, or inability to use, our site
- your reliance on any content on our site, including any lead
- loss of profits, sales, business or revenue
- business interruption
- loss of anticipated savings
- loss of business opportunity, goodwill or reputation
- any indirect or consequential loss or damage
We will not be liable for any loss caused by a virus or other technologically harmful material that may infect your equipment because of your use of our site, or for the content of any third-party site linked from ours.
Prohibited uses
You may use our site only for lawful purposes. You must not use it:
- in any way that breaches any applicable law or regulation
- in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
- to harm or attempt to harm anyone, including minors
- to send spam or any unsolicited advertising
- to transmit any viruses, trojans, worms, or other harmful code
You also agree not to reproduce, duplicate, copy, resell or redistribute any lead or any part of our site, and not to access without authority, interfere with, damage or disrupt the site, the servers on which it is stored, or any connected network or software.
Intellectual property
We are the owner or licensee of all intellectual property rights in our site and its content, which are protected by law. You may print or download extracts for your own internal business use. You must not use any part of the content for any other commercial purpose without a licence from us.
Suspension and termination
We decide, at our discretion, whether these terms have been breached. If they have, we may take any action we consider appropriate, including withdrawing your right to use the site, suspending or closing your account, issuing a warning, taking legal action to recover our costs, and disclosing information to law enforcement where we reasonably consider it necessary. These responses are not limited, and we may take any other action we reasonably consider appropriate.
Viruses and security
We do not guarantee that our site will be secure or free from bugs or viruses, and you are responsible for using your own virus protection. You must not misuse our site by knowingly introducing harmful material or attempting to gain unauthorised access to it or to any connected server or database. Doing so would be an offence under the Computer Misuse Act 1990; we will report any such breach to the relevant authorities and your right to use the site will cease immediately.
Linking to our site
You may link to our home page in a way that is fair and legal and does not damage our reputation, but you must not suggest any association or endorsement where none exists. We may withdraw linking permission at any time.
Governing law
These terms, their subject matter and their formation are governed by English law. You and we agree that the courts of England and Wales have non-exclusive jurisdiction; if you live in Scotland or Northern Ireland you may also bring proceedings there.
